Terms and conditions for online bidding in an auction to be held by the official auctioneer of the state of São Paulo Mr. James Arthur Lobo Lisboa, duly registered at the Board of Trade of the State of São Paulo under No. 336.

Of The Acceptance Of This Document

It is an essential condition for the BIDDER/USER to be able to use the present online bidding system to ACCEPT these “TERMS AND CONDITIONS” in their entirety, and must read and make sure they have understood and agreed to all of its clauses.

Of The Online Auction

The online auction is a facilitation tool offered by RAJA CONSULTORIA DE ARTE, EXPOSIÇÕES E LEILÕES LTDA., a private legal entity, registered in the CNPJ/MF under No. 11.076.358/0001-14, organizer of the auctions held by the Official Auctioneer James Lisboa, as a way to extend the possibility of participation in the event to the largest number of people possible.

It is not the responsibility of the Auctioneer or the company RAJA any problem regarding system failure, registration, internet connection maintenance, or others related, that may occur at the moment of the bidding and that prevent the USER of the online system from participating in the auction.

Of The User

Only people previously and duly registered in the online auction system will be able to use the facilitation tool offered herein.

Only people legally capable of contracting, including Legal Entities, provided they are represented by their legal representative, and financially capable of bearing the amount of the bid offered, plus the 5% (five percent) commission due to the auctioneer under the terms of Decree No. 21.981 of October 19, 1932, as well as the 5% (five percent) administration fee, both calculated on the hammer price, may register to participate in the online auction.

The USER undertakes to fill in the data contained in the registration form necessary for bidding via the online system only with true and complete data, committing to update them whenever there is any modification.

When registering to participate in the online bidding, the USER will have to choose a "username" and a password, both for personal and non-transferable use, being certain that the misuse of these data, by themselves or by third parties, will be the sole responsibility of the USER, who, in case of suspecting fraud or leakage of these data, must communicate the customer service center provided by the online system.

The USER declares to know that the data indicated by them in the registration form may be verified with government agencies or credit protection agencies, which may generate a request for additional information and may suspend their participation in the auction, in case of inconsistency between the information provided by the USER and the result of the research carried out.

The final qualification, with the USER's release to participate in the auction, will occur within 48 (forty-eight) hours after the complete filling of the registration form or any clarifications or provision of additional information.

The USER declares to be aware that any breach of this regulation or improper use of the online auction system will subject them to immediate disqualification from the system, with permanent interruption of their right to bid, in addition to responding civilly and criminally for such.

People who use the online auction system without paying attention to what is stated in the previous paragraphs will be considered in bad faith and may respond civilly and criminally for such.

All information provided by the USER to fill out the registration form, as well as their "username" and password, will be kept secure and safe from third parties, and may only be used for the purposes of using the online bidding system.

Of The Bidding

The bidder may bid online from the date and time of the respective auction, following in real time the beginning, development, and closing of the bidding for each lot.

Bids made before this date and time will be considered as prior bids and will be subject to those made on the date and time of the event, and may or may not be the winning bids.

The bids offered by the USER are irrevocable and irreversible.

All lots will be subject to a minimum price indicated by the owner.

The acquisition of the auctioned item will be made to whoever offers the highest value for the lot at the time of the auction, whether in person, by prior bids, by phone, or by using the present online system, being certain that after the declaration of the hammer by the Auctioneer, the purchase becomes a perfect legal act, and cannot be undone under any allegation that is not explicitly stated in this regulation.

Of The Notice

The USER of the online system who acts as the successful bidder must agree with the notice of this auction published on this site. After confirmation of reading the notice, no disputes will be accepted.

Of Disputes

Any disputes arising from the interpretation and execution of this regulation or the auction will be subject to Brazilian law and the jurisdiction of the Central Forum of the City of São Paulo.
